According to the Westmorland Gazette, the judge did not accpet the argument that the by-law was unenforceable for want of certainty. They argued that the fact that it refers to the speed in MPH and KPH and that the KPH figures are different in different sections meant if was unenforceable. The judge says no, it is clear enough and they were in breach of it either way. The breach was not caused by confusion it was a deliberate breach and, I suppose, if you set out to breach it, you must have to understand it in the first place, which would rather undermine the arguement.
The judge hasn't given his full judgment yet, but I suspect it's all over bar the shouting.
